Offshore Staff Leasing vs Employer of Record: Which Model Fits a UK Business?

By TalentDock Editorial Team · Updated 24 September 2026 · 8 min read

Quick answer
Offshore staff leasing means a provider recruits and employs staff abroad and "leases" them to you full-time; you direct their work. An employer of record (EOR) only employs someone you have already found and leaves recruitment and management to you. Managed offshore staffing is staff leasing plus local support: equipment, workspace, attendance, performance help and replacement. For most UK SMEs without their own overseas HR, managed staffing is the lowest-risk option.
The models

Three ways to employ people offshore without your own entity

Offshore staff leasing

The provider sources, hires and employs the person and bills you a monthly fee. The person works full-time for you. Also called offshore staff augmentation.

Employer of record (EOR)

A platform becomes the legal employer of a person you recruited, runs payroll and statutory filings, and charges a per-employee fee on top of salary and costs.

Managed offshore staffing

Staff leasing with the operational layer included: office or secure home set-up, devices, IT, attendance, HR, training, retention and replacement. Sometimes called offshore managed solutions.

When an employer of record makes sense

An EOR is useful when you have already found a specific person abroad, perhaps a former contractor, and want to employ them compliantly without setting up an entity. It is also used to hire in many countries at once.

The trade-offs: you still recruit, onboard, equip and manage; the EOR fee sits on top of salary and statutory costs; and if the person leaves you start again. For a first offshore hire with no local presence, that can be a lot to carry. Note that a UK EOR (employing someone in the UK) is a different product that keeps UK employer costs in place.

UK risks

UK compliance points for every model

  • Data protection: whichever model you use, you remain the controller. Put a data processing agreement and an IDTA or UK Addendum in place for transfers to countries without UK adequacy, such as Sri Lanka and the Philippines.
  • Status and tax: staff employed by an overseas provider and working wholly abroad are generally outside UK PAYE, employer NICs and IR35. Avoid informal “contractor” arrangements that blur who the employer is.
  • IP and confidentiality: make sure the provider’s employment contracts assign IP and impose confidentiality that flows through to you.

FAQ

Frequently asked questions

What is offshore staff leasing?

A provider recruits and employs staff in another country and leases them to your business full-time, while you direct their work.

What is an employer of record?

A company that becomes the legal employer of a worker you recruited, handling payroll, tax and statutory benefits in their country for a fee.

Is staff leasing the same as outsourcing?

No. With staff leasing you direct a dedicated person. With outsourcing, a supplier delivers an outcome using its own team.

What are offshore managed solutions?

Offshore staffing where the provider also manages the operational side: workspace, IT, HR, attendance, training and replacement.

Is EOR cheaper than managed offshore staffing?

The EOR fee alone can look lower, but you also pay for recruitment, equipment, management time and re-hiring. Compare the all-in annual cost.

Do I need my own company abroad to hire offshore?

No. Staff leasing, EOR and managed staffing providers all employ staff through their own local entities.

Which model is best for a UK SME?

Usually managed offshore staffing, because recruitment, employment and local support are handled for you.
